OVERVIEW

This website is operated by RETRUE. Throughout the Site, the terms "RETRUE," "we," "us," and "our" refer to RETRUE.

RETRUE offers this website, www.retrue.com (the "Site"), including the information, products, tools, features, and services available through the Site (collectively, the "Services"), subject to these Terms of Service ("Terms").

By accessing or using the Site, creating an account, placing an order, purchasing a product, submitting content, or otherwise using any part of the Services, you agree to be bound by these Terms and by the policies referenced in them, including our Privacy Policy and Return, Refund & Cancellation Policy.

If you do not agree with these Terms, please do not access or use the Services.

Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer our products and Services to you. Shopify and other third-party providers may process certain information as described in our Privacy Policy.

We reserve the right to update or modify these Terms from time to time. The current version will be posted on this page with an updated "Last Updated" date. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

SECTION 1 - ELIGIBILITY AND ONLINE STORE TERMS

By using the Services, you represent that you are legally capable of entering into a binding agreement in your jurisdiction.

If you permit a minor to access or use the Services under your supervision, you are responsible for that use to the extent permitted by applicable law.

You may not use the Site, Services, or our products for any illegal, fraudulent, unauthorized, or prohibited purpose.

You must not use the Services in a manner that violates applicable laws or regulations or infringes the rights of RETRUE or any third party.

You must not transmit viruses, malware, malicious code, or other technology intended to disrupt, damage, interfere with, or gain unauthorized access to the Site, Services, systems, or data.

A violation of these Terms may result in suspension or termination of your access to the Services.

SECTION 2 - GENERAL CONDITIONS

We reserve the right to refuse, restrict, suspend, or discontinue Services where reasonably necessary, including in cases involving suspected fraud, abuse, unlawful conduct, security risks, violations of these Terms, or transactions that we are unable to process.

We may modify, update, suspend, or discontinue any feature or portion of the Site or Services at any time, subject to applicable law.

You may not reproduce, duplicate, copy, sell, resell, exploit, reverse engineer, scrape, or commercially use any portion of the Site or Services without our prior written permission, except where such restriction is prohibited by applicable law.

Headings used in these Terms are provided for convenience and do not affect the interpretation of the Terms.

SECTION 3 - PRODUCT INFORMATION AND VEHICLE COMPATIBILITY

RETRUE sells automotive, towing, suspension, trailer security, and related products.

We make reasonable efforts to provide accurate product descriptions, specifications, compatibility information, photographs, diagrams, installation information, and other product-related materials.

However, vehicle configurations may vary by model year, trim level, drivetrain, suspension configuration, factory options, aftermarket modifications, lift or lowering kits, hitch systems, sensors, and other equipment.

Vehicle Fitment

Before purchasing or installing a vehicle-specific product, you are responsible for reviewing the complete fitment information on the applicable product page.

You should verify, where applicable:

Vehicle year, make, and model.
Drivetrain configuration.
Suspension configuration.
Factory options.
Existing aftermarket equipment.
Installation clearances.
Hitch or towing equipment.
Sensors, leveling systems, or other components that may affect installation.

A product being listed for a particular vehicle model does not necessarily mean that it fits every trim level or configuration of that vehicle.

Where a product page lists exclusions or special fitment requirements, those exclusions and requirements form part of the product description.

If you are uncertain about compatibility, please contact support@retrue.com before ordering or installing the product.

Product Images and Measurements

Product images are intended to represent our products as accurately as reasonably possible. Actual color, finish, packaging, surface appearance, or minor manufacturing details may vary slightly due to production changes, lighting, photography, monitor settings, or manufacturing tolerances.

Measurements and dimensions shown on the Site are provided for reference and may be subject to reasonable manufacturing tolerances unless otherwise stated.

Such minor differences do not necessarily constitute a product defect.

SECTION 4 - AIR SUSPENSION, TOWING, AND VEHICLE LOAD LIMITS

RETRUE air suspension products are intended to provide supplemental suspension support and help manage vehicle ride height when carrying or towing loads within the vehicle manufacturer's established limits.

Air Suspension Does Not Increase Vehicle Ratings

The load-leveling capacity stated for an air spring or air suspension kit does not increase or replace your vehicle manufacturer's:

Gross Vehicle Weight Rating (GVWR).
Gross Axle Weight Rating (GAWR).
Payload rating.
Gross Combined Weight Rating (GCWR).
Trailer towing capacity.
Hitch rating.
Tire or wheel load rating.
Any other factory-established weight or safety limitation.

You are responsible for operating your vehicle within all limits established by the vehicle, tire, wheel, hitch, and trailer manufacturers.

A vehicle appearing level after an air suspension system is inflated does not mean that the vehicle is within its legal or manufacturer-rated weight limits.

Towing Products

For towing-related products, you are responsible for confirming that all components used in your towing system are correctly rated for the intended application.

The lowest-rated component in the towing system may determine the maximum allowable capacity of the overall system.

RETRUE products must not be used to exceed vehicle, trailer, hitch, tire, wheel, or other component ratings.

SECTION 5 - INSTALLATION AND PRODUCT USE

Automotive and towing products must be installed and used correctly.

You are responsible for:

Reading the instructions provided with the product.
Reviewing product-page installation information.
Confirming compatibility before installation.
Using appropriate tools and procedures.
Properly tightening and securing all hardware.
Inspecting the installation before driving or towing.
Periodically inspecting installed components for wear, damage, looseness, leaks, corrosion, or other conditions requiring attention.

If you are not confident that you can safely install a product, we recommend having the product installed or inspected by a qualified automotive professional.

Modifying a product, using incorrect hardware, improperly installing a product, exceeding applicable ratings, or using a product in a manner inconsistent with its intended application may result in product damage, vehicle damage, loss of warranty coverage, or personal injury.

RETRUE is not responsible for damage resulting from improper installation, unauthorized modification, misuse, overloading, failure to follow instructions, or failure to maintain the product, except where responsibility cannot legally be excluded.

SECTION 6 - SECURITY PRODUCTS

RETRUE may offer trailer locks, hitch locks, coupler locks, wheel locks, and other theft-deterrent or security products.

These products are intended to help deter unauthorized access or theft.

No lock or security device can guarantee that theft, tampering, vandalism, or unauthorized access will never occur.

Statements relating to security, theft deterrence, durability, or resistance should not be interpreted as a guarantee that a product cannot be defeated, damaged, removed, or bypassed.

Customers remain responsible for evaluating the security measures appropriate for their property and circumstances.

SECTION 7 - ORDERS AND ORDER ACCEPTANCE

Submitting an order through the Site constitutes an offer to purchase the products listed in your order.

Receipt of an order confirmation does not necessarily mean that your order has been finally accepted or shipped.

We reserve the right, where reasonably necessary, to reject, limit, hold, or cancel an order, including where:

A product is unavailable.
Pricing or product information contains a material error.
Payment cannot be authorized.
Shipping information is incomplete or invalid.
We reasonably suspect fraud or unauthorized activity.
The order appears to violate these Terms or applicable law.
We are unable to ship the product to the requested destination.

If we cancel an order after payment has been collected, we will refund the applicable amount to the original payment method.

We may limit quantities purchased by an individual, household, account, payment method, billing address, or shipping address where reasonably necessary.

Commercial dealers, resellers, distributors, or wholesale customers may be subject to separate terms.

SECTION 8 - BILLING AND ACCOUNT INFORMATION

You agree to provide accurate, current, and complete information when placing an order or creating an account.

This may include your:

Name.
Billing information.
Shipping information.
Email address.
Telephone number.
Payment information.

You are responsible for ensuring that the information you provide is accurate enough for us and our service providers to process your transaction and deliver your order.

If incorrect information provided by you results in a failed delivery, delay, additional shipping charge, or returned package, additional charges may apply where permitted by law.

Payment transactions may be processed by Shopify and/or third-party payment providers. Their services may be subject to their own applicable terms and privacy policies.

SECTION 9 - PRICES, PROMOTIONS, AND AVAILABILITY

Product prices may change from time to time without prior notice.

The price applicable to an order is generally the price displayed when the order is placed, subject to correction of obvious pricing or technical errors and applicable law.

Promotional offers, coupon codes, discounts, bundles, gifts, and other promotions may:

Be available for a limited time.
Be subject to product or order exclusions.
Be limited to certain customers or regions.
Have minimum purchase requirements.
Be subject to quantity limits.
Not be combinable with other offers.

Unless otherwise stated, promotions have no cash value.

We reserve the right to modify or discontinue a promotion as permitted by applicable law.

Product availability is not guaranteed until an order is accepted and fulfilled.

SECTION 10 - ORDER CANCELLATIONS

Orders may be canceled within 1 hour after the order is placed.

If we receive your cancellation request within the 1-hour cancellation period, we will cancel the order and issue a full refund to your original payment method.

After the 1-hour cancellation period, an order may already have entered processing and can no longer be canceled.

If you no longer want the product after the cancellation period has expired, you may request a return after delivery in accordance with our Return, Refund & Cancellation Policy.

SECTION 11 - RETURNS, REFUNDS, AND EXCHANGES

Eligible products may be returned within 30 days after delivery in accordance with our Return, Refund & Cancellation Policy.

In general, eligible returns must be:

Unused.
Uninstalled.
Unmodified.
Not disassembled.
In the same condition in which they were received.
Returned with the original packaging.
Returned with all original parts, hardware, accessories, and manuals.

Returns must be authorized before they are sent back.

Product Quality or Fulfillment Problems

If a product is defective, damaged, or incorrectly shipped, we may request photographs, videos, order information, and other reasonable evidence to evaluate the issue.

After the issue is confirmed, RETRUE may provide an appropriate remedy, which may include:

Sending a replacement product; or
Accepting a return and issuing a refund.

Where the return is caused by a confirmed product quality problem, shipping error, or other error attributable to RETRUE, we will cover the reasonable return shipping cost.

Returns for Personal Reasons

If you return an eligible product because you:

Changed your mind.
No longer want or need the product.
Ordered the wrong product.
Ordered the wrong model.
Made another purchasing error unrelated to a product defect.

You are responsible for the return shipping cost.

RETRUE does not charge a restocking fee for eligible returns.

Promotional or discounted pricing alone does not make an otherwise eligible product non-returnable.

If there is a conflict between this Section and the detailed Return, Refund & Cancellation Policy regarding return procedures, the detailed policy will apply to the extent permitted by law.

SECTION 12 - SHIPPING AND DELIVERY

Shipping estimates displayed on the Site are estimates and are not guarantees unless expressly stated otherwise.

Delivery times may be affected by circumstances outside our reasonable control, including:

Carrier delays.
Weather.
Transportation disruptions.
Incorrect delivery information.
Remote delivery locations.
Customs or border processing where applicable.
Holidays.
Other events outside our reasonable control.

Tracking information may be provided when available.

You are responsible for providing an accurate and complete delivery address.

Nothing in this Section limits any delivery rights provided to you under applicable consumer law.

SECTION 13 - WARRANTY

Certain RETRUE products may include a limited product warranty.

Warranty coverage, duration, exclusions, claim procedures, and available remedies may vary by product and are described on the relevant product page, warranty documentation, or Warranty Policy.

Warranty coverage generally does not extend to damage resulting from circumstances such as:

Incorrect installation.
Misuse or abuse.
Overloading.
Accidents or collisions.
Unauthorized modifications.
Use outside the product's intended application.
Failure to follow installation or maintenance instructions.
Normal wear where excluded by the applicable warranty.
Damage caused by other vehicle components.

Warranty rights provided by applicable law are not excluded by these Terms.

SECTION 14 - ACCURACY OF SITE INFORMATION

We make reasonable efforts to maintain accurate and current information on the Site.

However, the Site may occasionally contain typographical errors, outdated information, technical errors, inaccuracies, or omissions relating to matters such as:

Product descriptions.
Vehicle fitment.
Product images.
Specifications.
Prices.
Promotions.
Inventory.
Shipping charges.
Delivery estimates.

We reserve the right to correct errors, update information, and, where permitted by law, cancel or adjust an affected order if material information was incorrect.

Nothing in this Section allows us to avoid obligations imposed by applicable consumer protection laws.

SECTION 15 - CUSTOMER ACCOUNTS

If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

You agree to provide accurate account information and promptly update information that changes.

You should notify us promptly at support@retrue.com if you believe your account has been accessed without authorization or compromised.

We may suspend or terminate an account where reasonably necessary to protect the customer, RETRUE, other users, or the integrity of the Services.

The Services may rely on or provide access to third-party technologies or services, including:

Payment processors.
Shipping carriers.
Analytics providers.
Advertising platforms.
Customer service tools.

Other applications or integrations.

We do not control all third-party services.

Your use of a third-party service may be governed by the terms and privacy policies of that third party.

To the extent permitted by law, RETRUE is not responsible for the independent acts, omissions, availability, content, security, or practices of third-party providers that are outside our reasonable control.

SECTION 18 - REVIEWS, COMMENTS, PHOTOS, AND OTHER USER CONTENT

You may have the opportunity to submit product reviews, comments, photographs, videos, feedback, questions, suggestions, or other content ("User Content").

You represent that any User Content you submit:

Is accurate to the best of your knowledge.
Does not violate applicable law.
Does not infringe intellectual property, privacy, publicity, or other rights of another person.
Does not contain malicious code.
Is not fraudulent, misleading, defamatory, threatening, obscene, or otherwise unlawful.

You retain any rights you may have in your User Content.

By voluntarily submitting User Content to RETRUE, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, publish, and distribute that content for purposes connected with operating, improving, promoting, and marketing RETRUE and the Services, subject to applicable law and our Privacy Policy.

We may moderate, remove, or decline to publish User Content that violates these Terms or our policies.

We are not obligated to publish or retain User Content.

SECTION 19 - INTELLECTUAL PROPERTY

Unless otherwise stated, the Site and its content, including:

RETRUE trademarks and logos.
Product photographs.
Graphics.
Text.
Product descriptions.
Videos.
Installation diagrams.
Layouts.
Software.
Website design.
Other original content.

are owned by or licensed to RETRUE and are protected by applicable intellectual property laws.

You may use Site content only for personal, non-commercial use relating to evaluating, purchasing, installing, or using RETRUE products unless we provide written authorization for another use.

You may not copy, reproduce, modify, distribute, publish, sell, license, or commercially exploit protected content without authorization.

Third-party trademarks, vehicle manufacturer names, model names, and product references displayed on the Site belong to their respective owners.

References to third-party vehicle or product brands are generally used for identification and compatibility purposes and do not necessarily indicate sponsorship, endorsement, affiliation, or authorization unless expressly stated.

To violate applicable laws or regulations.
To infringe intellectual property or other rights.

We do not guarantee that:

Every technical error will be corrected immediately.
Every product will be available at all times.
Every third-party service will remain available.
The Site will be free from every possible security threat.

Nothing in these Terms excludes or limits any statutory warranty, guarantee, consumer right, or other protection that cannot legally be excluded or limited.

Any express product warranty offered by RETRUE remains subject to its applicable warranty terms.

SECTION 23 - LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, RETRUE will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the use of the Site, Services, or products where such damages may lawfully be excluded.

Without limiting the foregoing, RETRUE is not responsible for loss or damage caused by:

Improper product installation.
Incorrect product selection where compatibility information was reasonably available.
Unauthorized product modification.
Misuse.
Overloading.
Operation beyond manufacturer-established vehicle or component ratings.
Failure to inspect or maintain installed products.
Third-party products or services outside our reasonable control.

Where liability cannot legally be excluded, these Terms do not exclude or limit that liability.

Nothing in these Terms limits liability for matters that applicable law does not permit us to limit or exclude.

SECTION 24 - INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold RETRUE and its affiliates, employees, representatives, service providers, and agents harmless from third-party claims, losses, liabilities, and reasonable expenses arising from your:

Material violation of these Terms.
Unlawful use of the Services.
Infringement of third-party rights.
Fraudulent or intentionally harmful conduct.

This Section does not apply to the extent that a claim results from RETRUE's own conduct or where such indemnification is prohibited by applicable law.

SECTION 25 - SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.

Where appropriate, an invalid provision may be interpreted or modified to the minimum extent necessary to make it enforceable.

These Terms remain effective while you use the Services.

You may stop using the Services at any time.

We may suspend or terminate access to the Services where reasonably necessary because of:

A material violation of these Terms.
Fraud or suspected fraud.
Security concerns.
Illegal activity.
Abuse of the Services.
Other circumstances where suspension or termination is reasonably necessary to protect RETRUE, our customers, or third parties.

Provisions that by their nature should survive termination will continue to apply, including provisions relating to intellectual property, liability, indemnification, payment obligations, and dispute resolution.

These Terms and any dispute arising from the Services will be governed by applicable law.

Nothing in these Terms limits mandatory rights or remedies available to consumers under the laws applicable in their place of residence.

If a dispute cannot be resolved informally, it may be submitted to a court or other forum with lawful jurisdiction over the dispute.

SECTION 28 - ENTIRE AGREEMENT

These Terms, together with the policies and other terms expressly referenced on the Site, constitute the agreement between you and RETRUE concerning your use of the Services.

Our failure to enforce a provision of these Terms does not constitute a waiver of that provision or any other provision.

If another RETRUE policy specifically governs a particular matter, such as returns, privacy, shipping, or warranty coverage, the more specific policy will apply to that matter to the extent permitted by applicable law.

We may revise these Terms from time to time to reflect changes in:
